Understanding Mediation - Is Mediation Right for You?
Mediation is a non-adversarial problem-solving process that focuses on
achieving solutions to difficult - often emotionally charged - legal concerns such as
family law disputes, personal injury-related insurance disputes, foreclosure and
other civil matters.
Mediation is facilitated by an impartial third party (the mediator) who
encourages communication between the parties, with an ultimate goal of
finding a mutually acceptable agreement. While an attorney's loyalty
lies with one party or side of a legal issue, the mediator is neutral
and facilitates communication between the parties, who may be in the same
room, but frequently are in separate conference rooms.
Whereas litigation proceedings can involve a high level of conflict, animosity,
and formality, mediation is confidential, non-adversarial and informal.
