The state of Florida recognizes three types of divorce. If your marriage is irretrievably broken, you and your spouse are legally married, and one of you has resided in the state for at least 6 months, you will be able to file for divorce in Florida.   1. Contested divorce. Contested divorce is the most common type of divorce. This process involves meeting in front of a judge and presenting evidence to support your arguments. The judge will then issue a divorce order.
  2. Uncontested divorce. If you and your spouse are able to agree on all relevant decisions regarding the divorce, you may be able to file for uncontested divorce. You will need to sit down with your spouse and create a final divorce agreement, and you will not need to appear before a judge.
  3. Simplified dissolution of marriage. The simplified dissolution of marriage is only available in certain situations. If you and your spouse have no children (and you aren’t pregnant), and you are able to agree on all decisions regarding the divorce, you may be eligible for a simplified dissolution of marriage. You will need to fill out a property settlement agreement and a financial affidavit, and have it approved by a judge in a final divorce hearing.
